EULA - End User License Agreement

SOFTWARE LICENSE AGREEMENT

This Software Licensing Agreement ("Agreement") is a legal agreement between you and Nikolai Vesselov ("Funny Arts"). By installing this Software, by loading or running the Software, by placing or copying the Software onto your hard drive, or by distributing the Software, you agree to be bound by the terms of this Agreement. These are the only terms by which Funny Arts permits copying or use.

General terms:

1. THE SOFTWARE.
The Software licensed under this agreement is the computer program Gem Zone, which consists of executable files, data files, and documentation.

2. GRANT OF LICENSE.
The Software is distributed by Funny Arts on a shareware basis. You are expected to use this program on your system and to thoroughly evaluate its usefulness and functionality before making a purchase. This "try before you buy" approach is the ultimate guarantee that the Software will perform to your satisfaction. Funny Arts grants you the right to the use Software in accordance with the terms of this Agreement. You may not modify, translate, disassemble, reverse engineer, decompile, or create derivative works based upon the Software. Any such unauthorized use shall result in immediate and automatic termination of this license and may result in criminal and/or civil prosecution.

3. SHAREWARE VERSION LICENSE.
You may distribute copies of the shareware version of the Software freely to other users, provided that any copy must contain the original, unaltered files and proprietary notices. You have the ability to register the Software at any time by purchasing it from Funny Arts. Once you have obtained the registered version, the Registered Version License below will then apply.

4. REGISTERED VERSION LICENSE.
When you register the Software, you will receive the registration key to unlock the full registered version. You agree not to distribute the registered version or registration key to others and to use it only for your own personal use of the Software. You acknowledge that unauthorized distribution of the registered version of the Software to others, whether intentional or unintentional, could damage Vendor both financially and professionally. Therefore, you agree that any unauthorized distribution of your registered copy of the Software to others will result in immediate and automatic termination of your license.

5. NO WARRANTY.
THE GEM ZONE IS DISTRIBUTED "AS IS". NO WARRANTY OF ANY KIND IS EXPRESSED OR IMPLIED. YOU USE IT AT YOUR OWN RISK. WE MAY NOT BE HELD LIABLE FOR DATA LOSS, DAMAGES, LOSS OF PROFITS OR ANY OTHER KIND OF LOSS WHILE USING OR MISUSING THIS SOFTWARE.

6. TERM.
The term of this license grant is perpetual. You may terminate this Agreement at any time by destroying all copies of the Software in your possession. Your license to use the Software will automatically terminate if you breach the terms of this Agreement.

7. DISTRIBUTION.
Author allows and encourages all web sites, on-line services, shareware disk vendors, CD-ROM vendors, bulletin board systems, and end-users to freely distribute the shareware version of this Software. If you wish to distribute the Software, you may obtain the most recent version from www.funnyarts.com. It is generally not necessary to contact Author for authorization, and you may begin offering the shareware version immediately.

8. COPYRIGHT.
The Software is exclusively owned by Funny Arts and is protected by copyright laws and international treaties. You must treat the Software like any other copyrighted material, except that you may make copies of the shareware version of the Software to give to other persons under the terms of this Agreement. You may not distribute copies of any registration key to other users. Except as expressly licensed by Funny Arts, Funny Arts reserves the exclusive copyright and all other rights, title and interest to distribute the Software, and to use Trademarks in connection with them. All rights not expressly granted here are reserved by Funny Arts.
